Privacy Policy

This Privacy Policy explains how We Are Music Promotions LLC dba HEARD ("HEARD," "we," "us," or "our") collects, uses, and protects information when you use heard.global, whether you're a fan, an artist, or another type of creator ("you").

This Policy applies alongside our Terms & Conditions. If there's a conflict between the two on a privacy matter, this Policy controls.

What we collect depends on how you use HEARD.

• Email address, and name or phone number if you provide them when making a purchase, claiming a free item, or signing up through an artist's page
• City, state, and country, if you provide them — for example, through an artist's Email Catcher popup or when purchasing an event ticket
• Purchase history on the platform (what you bought, from which artist, when)
• Payment information, which is collected and processed directly by Stripe — see Section 06

• Account information: name, email, bio, genre, city, and profile photo
• Content you upload: music, videos, images, merchandise listings, and event details
• Payout account information, connected and managed directly through Stripe Connect
• Information about fans who purchase from or subscribe to your page, which you can access through your dashboard

• Basic device and usage information (browser type, general location such as city/region, pages viewed)
• Camera and microphone access, only when you actively use a Live feature and only for the duration of that session

• To create and manage your account
• To process purchases and deliver the content, merchandise, or event access you paid for
• To send transactional messages, like purchase confirmations and event reminders
• To send marketing emails or texts from HEARD or from an artist you've opted in to hear from
• To help artists understand their audience through aggregated, non-identifying analytics
• To detect fraud, enforce our Terms, and keep the platform safe

If you opt in through an artist's Email Catcher or a similar sign-up form, that artist may send you text messages and emails about their music, tour dates, and offers. Message frequency varies, and message and data rates may apply.

We may also send you transactional emails related to your purchases or account, which are not subject to marketing opt-out (for example, a receipt or an event access link).

We do not sell your personal information. We share information only in the following circumstances:

• With the artist you purchase from or sign up with, since HEARD is a direct-to-fan platform — that artist becomes a controller of the information you give them
• With service providers who help us run the platform, including Stripe (payments), Supabase (hosting and data storage), Resend (transactional email delivery), and video/livestream infrastructure providers
• If required by law, subpoena, or to protect the rights, safety, or property of HEARD, our users, or the public
• In connection with a merger, acquisition, or sale of assets, in which case this Policy would continue to apply to your information

All payments on HEARD are processed by Stripe. HEARD does not store your full card number, CVV, or bank account number on our own servers. Your payment information is subject to Stripe's Privacy Policy in addition to this one.

HEARD uses browser local storage to remember basic session information, such as your email after a purchase, so you don't have to re-enter it. We do not use third-party advertising trackers to follow you across other websites.

We retain your information for as long as your account is active, or as needed to provide you the platform, comply with our legal obligations, resolve disputes, and enforce our agreements. If you request deletion, we will delete or anonymize your information except where we're required or permitted by law to retain it (for example, transaction records for tax purposes).

Depending on where you live, you may have the right to:

• Request a copy of the personal information we hold about you
• Request that we correct or update inaccurate information
• Request that we delete your personal information
• Opt out of marketing emails and text messages at any time

HEARD is intended for use only by individuals 18 years of age or older. We do not knowingly allow anyone under 18 to create an account, make a purchase, sign up to hear from an artist, or otherwise use HEARD — including our Live and Backstage features. If we learn that we've collected personal information from someone under 18, we will take steps to delete it.

Separately, and consistent with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13 under any circumstance. If you believe a child has provided us with personal information, please contact us at Mrbeheard@wampromotions.com and we will take steps to delete it.

We use industry-standard measures, including encryption in transit and access controls, to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 30 days before the changes take effect. Your continued use of HEARD after the effective date of the updated Policy constitutes your acceptance of the changes.
