Who We Are

HEARD is a direct-to-fan music and content platform owned and operated by We Are Music Promotions LLC, a Nevada limited liability company authorized to conduct business in the State of Georgia ("HEARD," "we," "us," or "our"). HEARD operates at heard.global.

HEARD provides technology infrastructure that allows independent artists, musicians, filmmakers, podcasters, and content creators ("Artist," "Creator," or "you") to host, display, and sell their content directly to fans.

What HEARD Is — and What It Is Not

HEARD is a hosting and technology platform. We are not a record label, management company, publishing house, distributor, or rights holder of any kind.

Ownership of Your Content

You retain full and exclusive ownership of all content you upload to HEARD. This includes but is not limited to:

By uploading content to HEARD, you grant HEARD a limited, non-exclusive, royalty-free license solely for the purpose of displaying and delivering your content to fans through the HEARD platform. This license does not transfer ownership and does not give HEARD the right to use your content for any other purpose.

HEARD will never sell, license, sublicense, or transfer your content to any third party without your explicit written consent.

Your Responsibilities
Eligibility
HEARD is intended for use only by individuals who are at least 18 years of age. This applies to everyone using the platform — fans and creators alike, including anyone making a purchase, signing up to hear from an artist, or participating in a Live or Backstage feature. HEARD does not knowingly permit anyone under 18 to create an account, make a purchase, or otherwise use the platform.

By using HEARD, you represent and warrant that:

You are solely responsible for your content and any claims, disputes, or legal actions arising from it. HEARD is not liable for any infringement claims related to content you upload.

Indemnification
You agree to defend, indemnify, and hold harmless HEARD and We Are Music Promotions LLC from any and all claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from a breach of the warranties above — including any third-party claim that your content contains an uncleared sample, interpolation, or otherwise infringing material. If content you uploaded generated any revenue prior to its removal, you remain solely responsible for accounting for and resolving that revenue with the applicable rights holder.
Section 05
Payments and Fees

HEARD charges a flat annual subscription fee for platform access. The current pricing is disclosed at heard.global at the time of signup. HEARD does not take any commission, percentage, or cut of any sales you make through your artist page.

All fan purchases are processed through Stripe. Sale proceeds are routed directly to your connected Stripe account. HEARD is not responsible for any delays, holds, or disputes initiated by Stripe or financial institutions.

Refund Policy

HEARD is a self-serve platform at every membership tier. The moment your payment is processed, you receive login credentials and full access to build your page and upload your own content.

Because account access is granted immediately upon payment, your subscription fee is non-refundable once your account has been created, except where required by applicable law.

As a courtesy, HEARD may assist with your initial content upload. This assistance is offered at HEARD's sole discretion, is not a guaranteed feature of your membership, and may be modified, limited, or discontinued at any time without affecting your access to the self-serve platform.

Content Standards

You agree not to upload, sell, monetize, or engage in conduct (including during a Live or Backstage session) that:

Outside of these limited restrictions, HEARD does not editorialize, curate, or control your creative content.

Live Conduct

These same standards apply in full to your conduct and behavior during any Live or Backstage session, in addition to any content you upload. Because live sessions happen in real time and cannot be reviewed in advance, HEARD or its systems may immediately end a live session, disconnect a guest, or suspend your ability to go live if a violation occurs, without waiting for the enforcement steps below.

Reporting a Violation

If you believe content on HEARD infringes your copyright or otherwise violates these standards, you can submit a report at heard.global/report. Reports are reviewed by HEARD directly, and we will investigate and take appropriate action, which may include removing the content and/or applying the enforcement steps below.

Enforcement

If HEARD determines your content violates these standards, we follow a three-step process:

HEARD reserves the right to skip directly to removal, without prior warnings, for severe violations — including repeat infringement, illegal content, or fraud.
Section 07
Fan Transactions

All transactions between you and your fans are direct commercial transactions between you and the fan. HEARD facilitates the transaction through its technology and payment processing infrastructure but is not a party to the sale.

You are responsible for any applicable taxes on your sales. HEARD does not provide tax advice and is not responsible for your tax obligations.

Section 08
Termination

You may cancel your HEARD subscription at any time. Upon cancellation, your artist page will be deactivated and your content will no longer be publicly accessible through HEARD. You may request deletion of your content and data at any time by contacting us at Mrbeheard@wampromotions.com.

HEARD may suspend or terminate your account if you materially breach these Terms and fail to cure the breach within 30 days of written notice, or immediately if the breach involves illegal content or fraud.

Disclaimers

HEARD provides the platform "as is" and makes no warranties, express or implied, regarding uptime, availability, or fitness for a particular purpose. HEARD will make reasonable efforts to maintain platform availability but does not guarantee uninterrupted access.

Section 10
Limitation of Liability

To the maximum extent permitted by law, HEARD's total liability to you for any claim arising out of or related to these Terms or your use of the platform shall not exceed the total amount you paid to HEARD in subscription fees in the twelve (12) months preceding the claim.

HEARD is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost revenue.

Section 11
Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in the State of Nevada, and you consent to personal jurisdiction in such courts.

We Are Music Promotions LLC is a Nevada limited liability company authorized to conduct business in the State of Georgia.

Section 12
Changes to These Terms

HEARD may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 30 days before the changes take effect. Your continued use of the platform after the effective date of the updated Terms constitutes your acceptance of the changes.
